Changes regarding cash registers and new reporting obligations: GEO no. 125/2024

The takeaway 

Government Emergency Ordinance (GEO) no. 125/2024 postpones until 31 December 2024 the application of contraventions for not having fiscal electronic cash registers. It also introduces as of 1 January 2025 for entities within the scope of authorisation, regulation, supervision and control of the Financial Supervisory Authority the obligation to report information regarding life insurance and other financial products to the central fiscal body. 

In detail 

According to GEO no. 125/2024, electric vehicle charging services which collect fees through commercial vending machines exclusively by using credit/debit cards and/or electronic wallet applications are exempt from the obligation to use fiscal electronic cash registers. 

The application of contraventions for failure to comply with the obligation of economic operators that deliver goods or provide services through commercial machines that operate on the basis of card payments, as well as those that accept banknotes or coins, to equip these devices with electronic fiscal cash registers has been suspended until 31 December 2024. However, this only applies in the case of those economic operators that, on the date of the inspection carried out by the tax authority, have concluded contracts for the purchase of electronic fiscal cash registers from authorised distributors, for all commercial machines used, with a delivery and installation deadline of 31 December 2024. 

The application of the sanction for issuing a fiscal receipt which does not contain the beneficiary’s identification code, the receipt identification number and data in the form of a QR code regarding the date and time of issuance of the fiscal receipt, as well as the fiscal series of the electronic fiscal cash register, has been suspended until 1 September 2025. 

The obligation to report information on life insurance and other financial products to the central tax authority on a semi-annual basis is introduced as of 1 January 2025 for entities within the scope of authorisation, regulation, supervision and control of the Financial Supervisory Authority. 

Information on the list of resident individuals who have contracted life insurance and other financial products, the types of insurance and other financial products and information related to them will be reported. 

Failure to comply with the reporting obligation or reporting incorrect or incomplete information is sanctioned by a fine of RON 20,000–100,000. 

Within 60 days as of the publication in the Official Gazette of GEO no. 125/2024, the types of life insurance and other financial products to be reported, as well as the reporting deadlines, will be approved by joint order of the President of the National Agency for Fiscal Administration and the President of the Financial Supervisory Authority.
