Government Emergency Ordinance no. 41/2022 (GEO no. 41/2022) established the procedure for the use and operation of the national system for monitoring the road transport of goods with high fiscal risk on the national territory (RO e-Transport system). It allows the competent authorities to determine potential deficiencies throughout the supply chain.

In detail

The Ministry of Finance, through the National Agency for Fiscal Administration and the Romanian Customs Authority, will use the RO e-Transport system to monitor the shipments on the national territory of goods with high fiscal risk.

The RO e-Transport system will generate unique registration codes for each goods transport (ITU), manage interconnection elements such as cameras and other road traffic monitoring devices, and analysis software. ITU codes will identify the goods related to each commercial relationship stated as the object of the transport of goods with high fiscal risk.

The obligation to declare data regarding the consignor, beneficiary, name, characteristics, transported goods’ quantities and value, loading and unloading places, details regarding the means of transport used and the ITU code in the RO e-Transport system rests with:

  • the consignee or consignor entered on the import or export customs declaration;

  • the beneficiary in Romania, in the case of intracommunity acquisitions of goods;

  • the Romanian supplier, in the case of internal transactions or intracommunity deliveries;

  • to the depositary, both for the goods unloaded on the territory of Romania for storage or for the formation of a new transport, and for the goods loaded after storage or after the formation of a new transport on the national territory.

A joint order of the President of the National Agency for Fiscal Administration and of the Romanian Customs Authority will establish the application procedure for the Ro e-Transport system and the categories of transport vehicles and goods with high fiscal risk transported by road to be monitored.

The measures regarding establishing contraventions and the related sanctions apply as of 1 July 2022, as provided in GEO no. 41/2022.

The provisions regarding the national RO e-Transport System regulated by GEO no. 130/2021 were repealed as of 11 April 2022, the date of entry into force of GEO no. 41/2022.
