New changes to the Fiscal Code: GEO no. 59/2024

Government Emergency Ordinance no. 59/2024 (GEO no. 59/2024) introduced changes to the excise duties area, and the amount of the minimum gross salary for which no income tax or social contributions are due has been increased to RON 300, starting with the salary income related to the month of July 2024.

In detail

The changes to the Fiscal Code are presented below:

  • In the excise area 

The changes in the area of harmonized excise duties include:

  • The movement of excisable products, for which there is an obligation to pay excise duties before delivery, is conducted on the basis of the proof of payment of excise duties to the state budget and the accompanying notice stating ‘excise duties levied’.

  • The delivery or movement of excisable products from the sphere of processed tobacco by the registered recipient will only be conducted with proof of payment to the state budget of the value of the excise duties related to the quantity to be delivered/moved and the existence of the buyer’s order in the case of the delivery of such products.

Failure to comply with these legislative provisions falls are treated as crimes and will be sanctioned.

Economic operators which hold the authorisation of certified recipients, for the places and products mentioned in the authorisation, are also included in the scope of the exemption from obtaining the certificate of distribution and wholesale sale of alcoholic beverages, processed tobacco and energy products – gasoline, diesel, lamp oil, liquefied petroleum gas and biofuels.

  • In the area of income tax and social contributions

The amount representing income from salaries and salary-related income for which no income tax is due and which is not included in the monthly base for calculating mandatory social contributions has been increased from RON 200 to RON 300/month. The measure applies to income from salaries and income treated as such related to the months of July–December 2024. The conditions regulated by Government Emergency Ordinance no. 115/2023 still applies.
