Commission Implementing Regulation (EU) 2018/1013 imposing provisional safeguard measures on imports of certain steel products into the Union (hereinafter “the Regulation”) was published on 18 July 2018. The Regulation entered into force on 19 July 2018.
Following a preliminary investigation initiated in March 2018, the European Commission concluded that the European Union's steel industry is under threat of serious damage to 23 product categories in the industry for which there has been an increase in import volumes.
In response, non-preferential tariff quotas were established on 19 July 2018 in relation to the imports into the Union of these 23 product categories, as listed in the table below.
These tariff quotas are applicable for a period of 200 calendar days from the date of entry into force of the Regulation and will be allocated in the chronological order of the dates on which the declarations of release for free circulation are accepted. Once a category quota has been reached, an additional 25% duty will be applied on the customs value of further such imported products in that category.
It is important to note that imports of the product categories covered by the Regulation already on their way to the Union on the date of entry into force of this Regulation and the destination of which cannot be changed, will neither be subject to the tariff quotas nor to the 25% additional duty. As such, these products can be released for free circulation in the Union without being subject to the measures imposed by Regulation.
Furthermore, in the case of imports into the Union of certain goods in the 23 product categories and originating from one of the developing countries under the Regulation but for which safeguard measures are not applicable, tariff quotas and the additional 25% duty do not apply.

As of 19 July 2018, the European Commission has provisionally imposed safeguard measures on imports of 23 product categories in the steel industry.
The measures take the form of non-preferential tariff quotas valid for 200 days from the date of entry into force of the Regulation. After the non-preferential tariff quotas have been reached, an additional charge of 25% will be levied on the 23 product categories.
The tariff quota / 25% additional rate does not apply to imports into the Union of certain goods in the 23 product categories originating in one of the developing countries under the Regulation.
We recommend that companies importing steel products into Romania perform an internal analysis of those operations to determine the impact of the Commission Regulation on their activities.
