Industrial Emissions

The Romanian Parliament has adopted Law no. 278 with respect to industrial emissions. This law transposes into the national regulatory framework the provisions of Directive 2010/75/EU of the European Parliament and of the Council dated 24 November 2010 on industrial emissions (integrated pollution prevention and control) (Recast), published in the Official Journal of the European Union series L no. 334 dated 17 December 2010.


This Law enters in force within 30 days as of its publication date in the Official Gazette of Romania, Part I. Certain provisions of this regulation will become effective sequentially until 1 January 2016.
Within the 60 days from the date of publication, the central environmental authority is to develop and approve, by an order of that authority, the procedure regarding the issuance of the integrated environmental authorisation / environmental authorisation.


The regulations regarding integrated pollution prevention and control, waste incineration, the establishment of certain measures on the limitation of volatile organic compounds emissions due to the use of organic solvents in certain activities and installations, the management of waste generated from the titan dioxide industry are amended as of the Law entering into force. The regulation regarding the establishment of measures regarding the limitation of certain air pollutant emissions generated by large combustion plants are amended as of 1 January 2016.
By adopting this Law, Romania intends to align with the obligations imposed by Directive 2010/75/EU with respect to industrial emissions and to:


• develop a unitary system for the integrated prevention and control of pollution;
• establish the conditions for emissions reduction to air, water and soil;
• establish the conditions for waste generation prevention,
so that a low level of environmental pollution would be generated.
